The clinical ethicist met with Ms. H to clarify what information she wants and does not want to know. First, she wants to receive any treatment that could prolong her life, regardless of how the treatment affects her ability to engage in activities of daily living. Second, she wants to be included in the decision‐making process as much as possible, as long as clinicians use only “positive” language. Ms. H considers the words “dying,” “chemotherapy,” “radiation,” and “cancer” to be “bad (...) words.” For conversations in which these words cannot be avoided, she wants her clinicians to talk to her son. Her desired engagement includes hearing about risks, benefits, and alternatives to treatments if clinicians use only “positive” language. Finally, she says that she rarely sees doctors and that she is “very scared” of hospitals, despite exhibiting a comfortable demeanor.Should clinicians honor Ms. H's waiver of specified information and, if so, to what degree? While valuable work has been done addressing clinical ethics within established healthcare systems, we anticipate that the projected growth in acquisitions of community hospitals and facilities by large tertiary hospitals will impact the field of clinical ethics and the day-to-day responsibilities of clinical ethicists in ways that have yet to be explored. Toward the goal of providing clinical ethicists guidance on a range of issues that they may encounter in the systematization process, we discuss key considerations and potential challenges in (...) implementing system-wide ethics consultation services. Specifically, we identify four models for organizing, developing, and enhancing ethics consultation activities within a system created through acquisitions: train-the-trainer, local capacity-building, circuit-riding, and consolidated accountability. We note each model’s benefits and challenges. To our knowledge, this is the first paper to consider the broader landscape of issues affected by consolidation. We anticipate that clinical ethicists, volunteer consultants, and hospital administrators will benefit from our recommendations. (shrink)

I respond to a challenge raised by Jordan Pascoe: Kant’s conception of obtaining full citizenship through working oneself up necessarily condemns some people to passive citizenship. I argue that we should not focus on work to establish universal full citizenship. Rather, a Universal Basic Income, an income paid regularly to everyone and without conditions, can secure everyone’s full citizenship. Moreover, I argue that such a scheme is more Kantian in nature than hitherto assumed.

What are the underlying processes that enable human beings to recognize a happy face? Clearly, featural and configural cues will help to identify the distinctive smile. In addition, the motivational state of the observer will influence the interpretation of emotional expressions. Therefore, a model accounting for emotion recognition is only complete if bottom-up and top-down aspects are integrated.

Music and Postwar Transitions in the 19th and 20th Centuries is the first book to highlight the significance of the idea of 'postwar transition' in the field of music and to demonstrate how the contribution of musicians, composers, and their publics have influenced contemporary understandings of war. At the intersection of four domains including: the relationship between music and war culture, commemorative and consolatory dimensions of music, migration and exile, and the links between music, cultural diplomacy, and propaganda, leading historians, (...) political scientists, psychologists, and musicologists explore disruptions and connections to music through the backdrop of war. Advances in neurotechnologies, artificial intelligence (AI) and Big Data analytics are allowing interpretation of patterns from brain data to identify and even predict and manipulate mental states. Furthermore, there are avenues through which brain data can move into the consumer sphere, be reidentified and brokered. In response to these developments, there have been a number of approaches proposed to strengthen protections of brain data. To better understand the landscape of brain data protection discussions, we conducted a scoping review to identify (...) the rationales for establishing brain data protections and the proposals for protecting brain data offered in the ethics and neuroscience literature. To draw comparisons, we also surveyed the rationales given in the literature for the protection of sensitive behavioral inferences drawn from other types of personal data and associated approaches to achieving protection. This systematic examination of the rationale behind heightened protection for brain data should be useful to clarify the functional and conceptual bases given for brain data protection and to provide a better grounding for evaluating how the different approaches to brain data protection address these concerns. The present study was designed to explore the relationship between self-reported dissociative experiences and performance in tasks eliciting right-hemisphere processing load. Thirty-four participants performed a vigilance task in two conditions: with task-irrelevant negative-arousing pictures and task-irrelevant neutral pictures. Dissociation was assessed with the Dissociative Experience Scale. Consistent with theories positing right-hemisphere deregulation in high non-clinical dissociators, dissociative experiences correlated with greater vigilance decrement only in the negative picture condition. As both the vigilance task and negative picture processing are right lateralized, (...) this result provides support for a right-hemisphere dysfunction in high dissociators, at least in negative conditions. This article re-evaluates the role of the manuscript tradition of the Historia Augusta in debates over the original contents and authorship of the text. Evidence for physical disruptions to the text before our oldest surviving manuscripts points to an earlier manuscript distributed across multiple codices. A multi-volume archetype eliminates critical arguments against the author's claims about lives missing before the Life of Hadrian as well as in the lacuna for the years a.d. 244–260. Other multi-volume codices of the eighth and (...) ninth centuries show that loss of an initial volume would have disrupted the textual tradition for the index, titles and authorial attributions. Comparison of our most complete early witness, Pal. lat. 899, to the independent branches of the textual tradition shows discrepancies between these paratextual elements as expected in a disrupted tradition. Ultimately, this article concludes that the current debates on authorship and the original scope of the Historia Augusta rest on paratextual elements from a single branch of the manuscript tradition, raising doubts about the centrality of these controversies to understanding the work. This paper studies the notion of virtuality in the Bohr-Kramers-Slater theory of 1924. We situate the virtual entities of BKS within the tradition of the correspondence principle and the radiation theory of the Bohr model. We show how, in this context, virtual oscillators emerged as classical substitute radiators and were used to describe the otherwise elusive quantum transitions. They played an effective role in the quantum theory of radiation while remaining categorically distinct and ontologically separated from the quantum world of (...) the Bohr model. The notion of virtuality thus differs markedly from its counterpart in quantum mechanics or QFT. (shrink)

In Spinoza’s metaphysics, we encounter many puzzling doctrines that appear to entangle metaphysical notions with cognitive, logical, and epistemic ones. According to him, a substance is that which can be conceived through itself and a mode is that which is conceived through another. Thus, metaphysical notions, substance and mode, are defined through a notion that is either cognitive or logical, being conceived through. He defines an attribute as that which an intellect perceives as constituting the essence of a substance. Intellectual (...) perception, something cognitive, is used to define an attribute, something metaphysical. And he claims that if something exists there is a reason why it exists and if something doesn’t exist there is also a reason why it doesn’t. Thus, a reason, something cognitive or epistemic, is necessary for existence or nonexistence. What are we to make of the intimate connections that Spinoza sees between metaphysical, cognitive, logical, and epistemic notions? Between being and reason? In this book, I argue for what might be called a realist interpretation: although Spinoza is confident that the order of being mirrors the order of reason, he believes that they are two orders, not one. There is inherence over and above conceptual dependence; there is causation in addition to causal explanation; the world has a nature that we can grasp and that our way of grasping it does not interpose an impenetrable conceptual veil between it and us. Ever since Kant and Hegel, the notion of autonomy—the idea that we are beholden to no law except one we impose upon ourselves—has been considered the truest philosophical expression of human freedom. But could our commitment to autonomy, as Theodor Adorno asked, be related to the extreme evils that we have witnessed in modernity? In Autonomy after Auschwitz, Martin Shuster explores this difficult question with astonishing theoretical acumen, examining the precise ways autonomy can lead us down a path of (...) evil and how it might be prevented from doing so. Shuster uncovers dangers in the notion of autonomy as it was originally conceived by Kant. Putting Adorno into dialogue with a range of European philosophers, notably Kant, Hegel, Horkheimer, and Habermas—as well as with a variety of contemporary Anglo-American thinkers such as Richard Rorty, Stanley Cavell, John McDowell, and Robert Pippin—he illuminates Adorno’s important revisions to this fraught concept and how his different understanding of autonomous agency, fully articulated, might open up new and positive social and political possibilities. Altogether, Autonomy after Auschwitz is a meditation on modern evil and human agency, one that demonstrates the tremendous ethical stakes at the heart of philosophy. (shrink)

In this paper I explore some ideas inspired by Federico Picinali’s Justice In-Between: A Study of Intermediate Criminal Verdicts. Picinali makes a case for the introduction of intermediate options in criminal trials – verdicts with consequences that are harsher than an acquittal, but not so harsh as a conviction. From a certain perspective, the absence of intermediate options in criminal trials is puzzling – out of kilter with much of our everyday decision-making and, perhaps, with the recommendations of expected utility (...) theory. I will argue, however, that the lack of intermediate options is much less puzzling when put in the context of our ordinary practices of blame and non-legal punishment. (shrink)

Moses Mendelssohn was the leading Jewish thinker of the German Enlightenment and the founder of modern Jewish philosophy. His writings, especially his attempt during the Pantheism Controversy to defend the philosophical legacies of Spinoza and Leibniz against F. H. Jacobi’s philosophy of faith, captured the attention of a young Leo Strauss and played a critical role in the development of his thought on one of the fundamental themes of his life’s work: the conflicting demands of reason and revelation. _ Leo (...) Strauss on Moses Mendelssohn_ is a superbly annotated translation of ten introductions written by Strauss to a multi-volume critical edition of Mendelssohn’s work. Commissioned in Weimar Germany in the 1920s, the project was suppressed and nearly destroyed during Nazi rule and was not revived until the 1960s. In addition to Strauss’s introductions, Martin D. Yaffe has translated Strauss’s editorial remarks on each of the passages he annotates in Mendelssohn’s texts and brings those together with the introductions themselves. Yaffe has also contributed an extensive interpretive essay that both analyzes the introductions on their own terms and discusses what Strauss writes elsewhere about the broader themes broached in his Mendelssohn studies. Strauss’s critique of Mendelssohn represents one of the largest bodies of work by the young Strauss on a single thinker to be made available in English. It illuminates not only a formerly obscure phase in the emergence of his thought but also a critical moment in the history of the German Enlightenment. (shrink)

We formulate from first principles a theory of stochastic processes in configuration space. The fundamental equations of the theory are an equation of motion which generalizes Newton's second law and an equation which expresses the condition of conservation of matter. Two types of stochastic motion are possible, both described by the same general equations, but leading in one case to classical Brownian motion behavior and in the other to quantum mechanical behavior. The Schrödinger equation, which is derived here with no (...) further assumption, is thus shown to describe a specific stochastic process. It is explicitly shown that only in the quantum mechanical process does the superposition of probability amplitudes give rise to interference phenomena; moreover, the presence of dissipative forces in the Brownian motion equations invalidates the superposition principle. At no point are any special assumptions made concerning the physical nature of the underlying stochastic medium, although some suggestions are discussed in the last section. (shrink)

I propose a novel way to understand the stringency of Kant’s conception of beneficence. This novel understanding can ground our intuition that we do not have to forego (almost) all pursuit of our personal ends. I argue that we should understand the application of imperfect duties to specific cases according to the framework set by the adoption and promotion of ends. Agents have other ends than obligatory ones and they must weigh obligatory ends against these other ends. Obligatory ends are (...) special among ends only insofar as their adoption is not optional. My reading of the normative status of imperfect duties affords a way of thinking about beneficence modelled on the everyday ways in which agents pursue their personal projects and weigh different ends against each other. This establishes a middle-ground between an extremely demanding conception of beneficence and an overly latitudinarian one. Furthermore, it helps us understand why we do not have to be maximally beneficent and why there is a bias towards the near in our thinking about rescue cases. (shrink)

What does it mean to wonder in awe or terror about the world? How do you philosophically understand Judaism? In How to Measure a World?: A Philosophy of Judaism, Martin Shuster provides answers to these questions and more. Emmanuel Levinas suggested that Judaism is best understood as an anachronism. Shuster attempts to make sense of this claim by alternatively considering questions of the inscrutability of ultimate reality, of the pain and commonness of human suffering, and of the ways in (...) which Judaism is entangled with the world. Drawing on phenomenology and Jewish thought, Shuster offers novel readings of some of the classic figures of Jewish philosophy while inserting other voices into the tradition, from Moses Maimonides to Theodor W. Adorno to Walter Benjamin to Stanley Cavell. How to Measure a World? examines elements of the Jewish philosophical record to get at the full intellectual scope and range of Levinas's proposal. Shuster's view of anachronism thereby provokes an assessment of the world and our place in it. A particular understanding of Jewish philosophy emerges, not only through the traditions it encompasses, but also through an understanding of the relationship between humans and their world. In the end, Levinas's suggestion is examined theoretically as much as practically, revealing what's at stake for Judaism as much as for the world. (shrink)

This chapter examines the traditional understanding of Horkheimer and Adorno's dialectic of enlightenment (exemplified by Jürgen Habermas and others), arguing that the traditional reading – with its stress on instrumental rationalization and a regressive or self‐destructive history – misses Horkheimer and Adorno's deepest aspirations, which are to offer an argument against a particular conceptualization of human agency (as apperceptive). Stressing instead, that Kant is the central interlocutor, the chapter shows how understanding this Kantian inheritance allows us to bring into focus (...) the radical nature of Horkheimer and Adorno's argument: that it is meant to bring into focus the problematic nature of conceiving human agency as dependent on apperception. In presenting this problem, the chapter shows how the ontogenetic origin of self‐consciousness becomes a crucial issue, and the thought of Sigmund Freud is marshaled both to make this clear and to show how Horkheimer and Adorno's account can benefit from making explicit its potential debt to Freud. In my thesis I explain why the common, pre-theoretical understanding of morality is an important part of Kant’s ethics, and I critically evaluate what the strengths and weaknesses are of doing ethics with the common perspective as a point of reference. In chapter 1, I discuss the significance of common rational capacities for the deduction in Groundwork III as well as for the Fact of Reason. Attention to the fundamental role of common rational capacities in the Second Critique reveals that (...) Kant intends to provide further warrant for the Fact than its introspective self-evidence. In chapter 2, I discuss what it means for a rational agent to be endowed with common rational capacities. The agent has everything she needs to reason on her own about what she ought to do and act from rational judgements. Furthermore, I critically evaluate Kant’s claim that his ethics spells out fundamental, pre-theoretical convictions. In chapter 3, I discuss Kant’s conception of rationalizing. I analyse rationalizing as a process of self-deception in which an agent tries to justify or excuse violations of the moral law. This can lead to loss of the reliable use of common rational capacities. I discuss what help critical practical philosophy and moral education can afford against rationalizing. In chapter 4, I argue that Kant saw dialogical engagement with ordinary agents as an important way of obtaining data concerning the correct starting point of practical philosophy. Kant demands that whatever we get from dialog and observation has to be isolated from its contingent elements. I conclude that the main problem for Kant’s method is how we can, on the one hand, exclude non-rational content, and, on the other hand, be open to what other agents actually have to say about morality. This article elaborates Theodor W. Adorno’s understanding of ‘negation’ and ‘negative theology.’ It proceeds by introducing a typology of negation within modern philosophy roughly from Descartes onwards, showing how Adorno both fits and also stands out in this typology. Ultimately, it is argued that Adorno’s approach to negation and thereby to negative theology is throughout distinguished and infused by an ethical commitment.
